Letter from the President of the Canadian Diamond Drilling Association (in part)
"Clearly, the Provincial and Federal Human Rights Commissions are
presently unsettled in their position on drug and alcohol testing
in the workplace. Until the time when a clear policy is released,
employer testing policies will be under a cloud of suspicion on the
basis of the current jurisprudence. However, it has been acknowledged
by the Federal Human Rights Commission that it is possible to design a
drug and alcohol testing policy which has a reasonable chance of being
held not in contravention of the handicap provision of the Human Rights Code.
We in the diamond drilling industry have that window to
implement a sound policy without being held in contention
of a Human Rights violation. There is no doubt that
diamond drilling is a safety-sensitive position. However,
companies have to ensure that all reasonable steps have
been taken to educate our workforce and accommodate them
through rehabilitation programs if they encounter a positive
test result. That being said, it is essential to research the
topic and enlist the help of a professional organization
which can assist a company through the various essential
aspects of a drug and alcohol testing program.
The Canadian Diamond Drilling Association has identified
CannAmm Drug and Alcohol Testing Inc. as perhaps one of
the most reputable firms dealing with this issue.
CannAmm is well aware of the unique nature of the diamond
drilling industry and has spearheaded the implementation of a
drug and alcohol testing program for some member companies."
